Orca PM – Residential Property Rentals

Welcome to Orca PM! These Terms and Conditions (“Terms”) govern the rental of residential properties provided by Orca PM (“we,” “us,” or “our”) to you, the tenant (“you” or “tenant”). By entering into a rental agreement with Orca PM, you agree to be bound by these Terms, along with any additional lease agreements or policies referenced herein. Please read these Terms carefully.

  1. Rental Agreement

1.1 Lease Contract: The rental of any property from Orca PM is subject to a signed lease agreement between you and Orca PM. These Terms supplement, but do not replace, the lease agreement. In case of any conflict between these Terms and the lease agreement, the lease agreement will prevail.
1.2 Eligibility: To rent a property from Orca PM, you must be at least 18 years of age and provide accurate, complete, and current information during the application process.
1.3 Property Use: Properties rented from Orca PM are for residential use only unless otherwise specified in writing. Commercial activities, illegal activities, or any use that violates local laws or regulations are strictly prohibited.

  1. Payment Terms

2.1 Rent: Rent is due on the date specified in your lease agreement, payable in U.S. dollars (or applicable local currency) via the payment methods accepted by Orca PM.
2.2 Late Fees: If rent is not paid by the due date, late fees may apply as outlined in your lease agreement.
2.3 Security Deposit: A refundable security deposit is required prior to move-in, as specified in your lease agreement. The deposit will be returned, less any deductions for damages or unpaid fees, within the timeframe required by local law after the lease ends.
2.4 Additional Fees: You may be responsible for utilities, maintenance fees, or other charges as outlined in your lease agreement.

  1. Tenant Responsibilities

3.1 Property Maintenance: You agree to keep the rented property clean, sanitary, and in good condition, reporting any maintenance issues to Orca PM promptly.
3.2 Damages: You are responsible for any damage to the property caused by you, your guests, or pets (if permitted), beyond normal wear and tear.
3.3 Compliance: You agree to comply with all applicable laws, ordinances, and homeowners’ association (HOA) rules, if any, related to the property.
3.4 No Alterations: You may not make alterations, repairs, or improvements to the property without prior written consent from Orca PM.

  1. Orca PM Responsibilities

4.1 Property Condition: Orca PM will provide the property in a habitable condition, compliant with local housing codes, unless otherwise agreed.
4.2 Repairs: We will address necessary repairs reported by you in a timely manner, subject to reasonable availability of resources and contractors.
4.3 Access: Orca PM reserves the right to access the property for inspections, repairs, or showings with reasonable notice, except in emergencies where immediate access may be required.
